1. Setup

What is EMAS and what is the aim of the system?
EMAS is the European Union's voluntary environmental management and audit system. It offers organizations a methodological framework to systematically record their environmental performance, continuously improve it, report transparently and have it audited externally. EMAS therefore goes beyond pure compliance management: it combines management system logic (Plan-Do-Check-Act), annual performance indicators, legal completeness checks and public accountability in an integrated structure.
On what legal basis is EMAS based?
The central legal source is the Regulation (EC) No. 1221/2009 („EMAS III“). She was, among other things, updated by Regulation (EU) 2017/1505 (adaptation to ISO 14001:2015) and Regulation (EU) 2018/2026 (complete recast of Annex IV to the environmental statement). All changes are maintained in a consolidated version by the Commission and are immediately valid in all EU countries.

How does EMAS differ from ISO 14001
Both systems share the same management system core, but EMAS requires: (1) annual, publicly available and validated environmental statement, (2) explicit legal compliance audit reports, (3) registry entry and EMAS logo use, (4) more regular external on-site verification. EMAS thus offers more transparency and official recognition, while ISO 14001 focuses more on internal control.

What must environmental policy contain?
It must describe at least (a) a commitment to complying with all environmentally relevant laws, (b) the striving for continuous improvement of environmental performance, (c) prevention rather than aftercare and (d) willingness to engage in dialogue with stakeholders. Policy is at the forefront of the system and is confirmed annually in the environmental statement.
What is the environmental statement and what requirements apply
The document reports yearly about environmental policy, target achievement, key figures (energy, emissions, water, waste, etc.) and planned measures. It must be clear, quantitative, understandable for laypeople, validated by the reviewer and then publicly accessible (website, register). Changes in 2018/2026 have standardized the format and core indicators.
What role does the environmental verifier play?
The assessor checks environmental assessment, EMS, audit processes, legal compliance and the credibility of all data. He validates the environmental statement, visits sites, conducts interviews and issues a validation protocol that is submitted to the register. Its work is regulated through national accreditation bodies; Guidelines define minimum visit and inspection intervals.
How long is the registration valid and how does the extension work?
The registration is three years valid. An (abridged) environmental statement must be revalidated every year. A complete re-verification takes place before the end of the third year. Small organizations can apply for extended intervals provided they can demonstrate a low environmental impact.
What costs typically arise?
External costs: Validation/verification fees (depending on location number.

What advantages does EMAS bring to government and legal practice?
Proven legal conformity makes approvals easier, reduces compliance checks, and shortens reporting obligations (e.g. TA-Luft, circular economy and energy label laws). Some countries combine relief in environmental taxes or give preference to EMAS companies in public tenders.
How big is the EMAS community currently?
Stand November 2024 are 4 101 organizations with 17,208 locations registered. Leading the way are Italy, Germany, Spain, Austria and Denmark; Most common sectors: public administration, waste/water services, mechanical engineering.
Are there special regulations for SMEs
Yes. Organizations with fewer than 250 employees and ≤ €50 million in sales can:
Extend test cycles to 4 years (instead of 3 years),
prepare shortened annual environmental statements,
Apply simplified core indicators.
The prerequisite is an application to the responsible authority in accordance with Article 7 EMAS.
Can companies outside the EU use EMAS
Yes. Art. 3 Para. 3 opens „Global Registration“. Registration takes place either via an EU parent company (corporate registration) or directly with a national EMAS authority if it offers third-country registration (e.g. Austria, Spain). How can the EMAS logo be used?
Only registered organizations are allowed to use the logo – however not on products or packaging to avoid confusion with eco-labels. Annual reports, websites, letterheads, location signs, vehicle fleets or marketing materials are permitted as long as they do not make a product reference and provide the registration number
How to integrate EMAS into CSRD/ESG reports
The EMAS core indicators (energy consumption, Scope 1/2 emissions, water, waste, land use) cover large parts of the EFRAG-ESRS E1–E5 away. According to ESRS 1 § 121, data that has already been validated can be adopted „by reference“; This reduces testing costs and the EMAS expert protocol can function as „limited assurance“ for CSRD.
